Ferry Carpool Terms and Conditions

1. Acceptance and Eligibility
By accessing Ferry Carpool, posting a listing, contacting another user, or arranging a ride through the platform, you agree to these Terms and Conditions in full. If you do not agree, do not use the platform.
You must be at least 19 years old to use this platform. By using Ferry Carpool, you represent and warrant that you are 19 years of age or older. If you are under 19, you are not permitted to use this platform.
2. What Ferry Carpool Is, and Is Not
Ferry Carpool is a passive online notice board where private individuals may post or browse voluntary carpool listings connected to BC ferry travel. Ferry Carpool does not organize, match, prioritize, recommend, rank, or assign rides. Listings are user-generated and displayed without ranking based on commercial factors, payment amount, driver status, passenger status, or platform preference.
Ferry Carpool does not provide transportation, employ drivers, dispatch vehicles, set fares, sell ferry tickets, broker transportation, operate a transportation network company, or guarantee that any ride will occur. Any ride arrangement is made directly and voluntarily between private individuals. Ferry Carpool is not a party to any such arrangement.
3. Cost Sharing, Not Commercial Rides
Listings must be for genuine private carpools only. Any contribution requested from a passenger must be limited to a reasonable share of actual trip costs, such as fuel, ferry fares, parking, reservation fees, and similar direct travel expenses. You must not use Ferry Carpool to make a profit or to operate a taxi, limousine, ride-hailing service, shuttle, charter, courier, or any other commercial passenger transportation service.
Drivers are solely responsible for confirming that their driver's licence, insurance policy, vehicle use, and any cost-sharing arrangement comply with British Columbia and Canadian law, including the Passenger Transportation Act and applicable ICBC or private insurance requirements. Drivers are strongly encouraged to contact their insurer directly to confirm that their specific policy covers their vehicle while carrying cost-sharing passengers.
4. User Responsibilities
You are responsible for the accuracy of your listing, your communications with other users, your decision to meet or travel with another person, and your compliance with all applicable laws, ferry operator rules, road rules, insurance requirements, and safety obligations.
Drivers must hold a valid driver's licence, operate a safe and legally roadworthy vehicle, carry legally required insurance, provide a functioning seatbelt for every passenger, avoid impaired or distracted driving, and comply with all ferry terminal and traffic rules.
Passengers must act respectfully, wear a seatbelt at all times, avoid unsafe conduct, and pay any agreed lawful cost contribution directly to the driver.
5. No Screening or Verification
Ferry Carpool does not verify identities, driver's licences, insurance coverage, criminal or driving records, vehicle condition, ferry reservations, ticket status, or the accuracy of any listing. You must conduct your own checks and exercise your own judgment before agreeing to any ride. The presence of a listing on this platform is not an endorsement or verification of any kind.
6. Ferry Schedules and Third-Party Information
Ferry schedule data displayed on this platform is provided for planning convenience only. It may be derived from public schedule sources and is not guaranteed to be accurate, complete, or current. Schedules, capacity, delays, reservations, cancellations, fares, and terminal rules can change without notice. Always verify important travel details directly with the ferry operator before travelling.
Ferry Carpool is an independent service. It is not affiliated with, endorsed by, or controlled by BC Ferries or any other ferry operator.
7. Prohibited Conduct
You must not:
- Post false, misleading, discriminatory, abusive, illegal, unsafe, or commercial transportation listings.
- Harass, threaten, intimidate, or deceive other users.
- Collect, store, or misuse personal information submitted by other users.
- Scrape, copy, or automate access to the platform without permission.
- Use the platform to arrange or facilitate any illegal activity.
- Evade any safety, moderation, or security measure.
- Operate repeated listings in a way that resembles a commercial transportation business.
- Use the platform if you are under 19 years of age.
Ferry Carpool may remove listings and suspend access where prohibited conduct is identified or reasonably suspected. Users who repeatedly violate these Terms may be permanently blocked from the platform.
8. Payments
Ferry Carpool does not process, hold, escrow, or guarantee any payments. Any cost contribution is arranged entirely and directly between the driver and passenger. Users are solely responsible for confirming the amount, timing, method, refund expectations, and whether ferry tickets or reservations are included in any arrangement.
9. Privacy, Personal Information, and Your Rights
Ferry Carpool collects and uses personal information in accordance with British Columbia's Personal Information Protection Act (PIPA) and, where applicable, Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
Information collected includes listing content such as route, pickup, drop-off, and description; your email address; technical and abuse-prevention information; and terms-acceptance records. Contact messages are delivered by email. The platform may retain limited contact metadata such as delivery status and consent timestamps. Message content is not stored by the platform.
This information is collected and used for reasonable purposes, including publishing listings, delivering contact messages, operating and securing the service, preventing abuse, responding to support or legal requests, and complying with legal obligations. It is not sold or shared with third parties for marketing purposes.
Your rights: You may request access to your personal information, request corrections, or request deletion of your data by contacting the site operator through the support page. Requests will be handled within a reasonable time, subject to identity verification and any legal or operational reason to retain limited records.
Data is retained only as long as necessary to operate the service, prevent abuse, resolve disputes, respond to lawful requests, or meet legal obligations. Public listings expire automatically after the travel time, but limited records such as terms acceptance, delivery status, or moderation history may be retained where reasonably necessary.
Do not post sensitive personal information, such as home addresses, phone numbers, financial details, or government ID numbers, in public listings.
10. Platform Availability and As-Is Disclaimer
The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, uninterrupted availability, security, accuracy, or freedom from error. The platform may be unavailable, slow, modified, suspended, or discontinued at any time without notice. Ferry Carpool makes no guarantee that listings will be accurate, available, lawful, safe, or result in a ride.
11. Assumption of Risk
Travelling with private individuals you have met online involves real and serious risk, including personal injury, assault, theft, property damage, delay, missed sailings, ride cancellations, payment disputes, misconduct, criminal acts by third parties, and other loss. Ferry Carpool is not responsible for the criminal, tortious, unsafe, negligent, or unlawful conduct of any user. By using this platform and arranging or accepting a ride, you voluntarily and knowingly assume all such risks.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Ferry Carpool and its operators, contributors, and hosting providers are not liable for user conduct, vehicle operation, accidents, personal injury, assault, theft, property damage, financial loss, missed sailings, cancelled rides, payment disputes, inaccurate listings, unavailable schedules, criminal acts of third parties, failures of any third-party service, or unauthorized access caused by a user's own conduct. Nothing in these Terms limits liability in circumstances where the law does not permit such limitation, including liability for death or personal injury caused by gross negligence or fraud.
13. Indemnity
You agree to indemnify, defend, and hold harmless Ferry Carpool and its operators from any claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from your listings, communications, ride arrangements, conduct, breach of these Terms, or violation of any applicable law.
14. Content Removal, Reports, and Access Termination
Ferry Carpool may remove any listing or content, block any message, and suspend or permanently terminate any user's access at any time, for any reason, with or without notice, including but not limited to violation of these Terms, reports from other users, suspected illegal activity, risk to user safety, or the operational needs of the platform. Ferry Carpool is not obligated to provide a reason for removal or termination.
Users may report listings or conduct that appears unsafe, commercial, misleading, abusive, illegal, or in breach of these Terms. Ferry Carpool may review reports at its discretion, but does not guarantee that every report will be investigated, resolved, or acted on within any specific time.
15. Changes to These Terms
Ferry Carpool may update these Terms at any time. The updated date at the top of this page reflects when the Terms were last revised. Continued use of the platform after an update constitutes your acceptance of the revised Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of British Columbia and the applicable laws of Canada. Subject to any mandatory consumer protection rules that cannot be contractually waived, disputes will be resolved in the courts or appropriate tribunals located in British Columbia.
